Personal Data Being Processed

The Company may collect the following Personal Data from you:

Customers

Identification data; Full name, official identification, age, sex, nationality, signature, username and password.

Tax data. Fiscal address, Federal Taxpayer Registry number (R.F.C.), certificate of compliance (SAT).

Property-related data. Bank account number, bank card number, ability to pay, credit history (information we may obtain directly from you or from Credit Information Companies).

Suppliers

Identification data. Full name, official identification, age, sex, nationality, signature, username and password.

Contact details. Complete address, e-mail, mobile and/or fixed telephone number.

Tax data. Fiscal address, Federal Taxpayer Registry number (R.F.C.).

Property-related data. Bank account number, bank card number.

Personal data of third parties. Medical certificates (considered Sensitive Personal Data) and identification and contact details of the supplier's employees, in those cases where certain of the supplier's personnel are assigned to work in the Company's facilities or other companies in the same group. Customer and Supplier Representatives

Identification data. Full name, official identification, age, sex, nationality, signature, plates, car.

  •    Keep in touch with you on the occasion of the business relationship.

  •    Create an account for your access to the Platform for Suppliers and Customers, and allow your access and use of it for issues related to purchase orders, invoicing, payments, etc.

  •    Make collections and issue the corresponding invoices.

  •    If required, by the type of services you provide or the type of information you have access to, to carry out regular assessments of your commercial status, use of harmful substances and/or other tests of confidence.

  •    In general, carry out the business relationship.

  •    Ensure our security, and the security of our information, that of our employees, other Customers, Suppliers, related companies and third parties.

  •    Make the Transfers mentioned in the following section.

  •    Comply with the requirements of the competent authorities, fulfil legal obligations and take legal action.

Customer and Supplier Representatives

  •    To be in a position to conclude contracts, to sign credit instruments and to maintain a commercial relationship with the person (natural or legal) he represents.

  •    Where appropriate, to give you access to, and allow you to use on behalf of, the Platform for Suppliers and Customers.

Transfer of Personal Data

Your Personal Data may be transferred to the following third parties, for the purposes specified.

 

Recipient of Personal Data Purpose
Companies that are part of the same corporate group as the Company (DINE) To fulfill any of the purposes, including the voluntary ones, mentioned above. In general, for the achievement of the relationship we have with you or your represented.
Competent authorities. To comply with requirements of the competent authorities, to fulfill legal obligations, for the recognition, exercise or defense of a right in an administrative or judicial process; as well as in the cases specifically allowed by the LFPDPPP.
Credit information companies (in some cases, in relation to Customers) To obtain information that will allow us to evaluate your credit situation and the granting of possible financing or credit.

 

 

Ways to Exercise Your Rights

You have the right to know what Personal Data we hold about you, what we use it for and how we use it, as well as the Privacy Notice governing its processing (Access). You can also request that we correct or update your Personal Data (Correction); that we delete your Personal Data in situations where this is possible (Cancellation); as well as to oppose the processing of your Personal Data for specific purposes (Opposition) (collectively "ARCO rights"). Similarly, you may limit the use and disclosure of your data or revoke your consent to their processing, where this is possible and applicable.

Your application must contain at least the following information:

  •    The document proving your identity (copy of official identification) and, where appropriate, the personality of your representative (with a copy of the corresponding official identification)

  •    The clear and precise description of the Personal Data with respect to which it seeks to exercise any of the rights and the right it exercises.

  •    Any document or information that facilitates the location of your Personal Data.

  •    If you request a correction of Personal Data, you must also indicate the modifications to be made and provide the documentation supporting your request.

We will respond to your request within 20 working days of receipt and, if appropriate, we will have 15 working days to implement your request.

Access to your Personal Data will be deemed to have been granted when it is made available to you, regardless of the means or format; or when you are provided with simple copies of your Personal Data, at the Company's option.

Confidentiality

All information to which you have access in connection with your business relationship with the Company (including, without limitation, Personal Data, intellectual property, trade secrets, know-how, project information, costs, information about your business relationship with the Company, etc.), whether as a Customer or a Supplier, or as a representative of our Customers or Suppliers, is strictly confidential. In that sense, it is forbidden to use it for purposes other than the fulfillment of the obligations arising from the business relationship. It is also prohibited to transfer such information to third parties without the prior written consent of the Company.

You, as the Customer, Provider, or their representative, agree to implement sufficient and necessary security measures to protect the confidential information to which you have access from any type of damage, loss, destruction, alteration, unauthorized use or disclosure. The security measures implemented, in no case can be less than those you maintain to protect your own confidential information.

Amendments to the Privacy Notice

We reserve the right to make changes or updates to this Privacy Notice at any time. If there are substantial changes, we will send you the updated version of the Privacy Notice to your email address, or a notification of changes and the updated version of the Privacy Notice will be published on the Supplier and Customer Platform.

Consent

By maintaining a business relationship with the Company, providing your Personal Data, acting as a representative of a person (physical or moral) who has a business relationship with the Company and/or making use of the Platform for Suppliers and Customers, you give your express consent to the use of your Personal Data under the terms described in this Privacy Notice.
